Sources tell FOX Sports 1’s Mike Garafolo that Cleveland Browns Pro Bowl wide receiver Josh Gordon’s one-year suspension has been upheld despite appeal. The NFL later confirmed said ruling with a press release.
Per ESPN’s Adam Schefter, the Browns had been growing a bit impatient with the NFL’s unwillingness to rule on the potential suspension of Gordon. Schefter, late Tuesday, reported that the league had come to a decision, but was attempting to decide just when to disseminate said ruling. On Wednesday, word comes out that, while the team has continued to verbally refer to the “process” with patience, concern was bubbling. And rightfully so.
“While we may have strong feelings on the timing and process of this decision, we have also consistently communicated that we will focus on what we can control in our day-to-day approach,” said Browns GM Ray Famer. “Right now, that is preparing our team for the 2014 season and, at the same time, supporting Josh however we are able under NFL guidelines during his suspension.”
Concern was that Gordon, who would not get to apply for reinstatement for one year, would essentially miss all of next year’s training camp due to the longevity of this appeal. ESPN Cleveland’s Tony Grossi had mentioned a potential scenario where even if Gordon gets a one-year ban for violating the league’s drug policy, he would be able to apply for reinstatement after eight games and work out with the Browns during this time. This does not appear to be the case. Gordon’s eligibility for 2015 will be determined following the completion of the 2014 season.
In a statement released by the NFLPA, Gordon said the following: “I’d like to apologize to my teammates, coaches, the Cleveland Browns organization and our fans. I am very disappointed that the NFL and its hearing office didn’t exercise better discretion and judgement in my case. I would like to sincerely thank the people who have been incredibly supportive of me during this challenging time, including my family, my agent, my union, my legal team, and the Cleveland Browns staff.”
Per NFL.com’s Ian Rapoport, The Browns have argued to keep Gordon around the team’s training facility in order to provide him with the help he needs. No word on if it will happen or if Gordon plans to sue the NFL following the handling of his case. He’s getting plenty of support for doing so.
“We will continue our support of Josh and we understand that there is accountability for one’s actions,” said Browns head coach Mike Pettine. “Our job and that of the team is to focus on what we can control. Our philosophy in building this team an the mentality we’re establishing is that we’re going to overcome challenges and situations throughout the course of the season. We’ll continue to be relentless in our approach, in how we work and focus on our goal of returning winning football to Cleveland.”

There is nothing in that article that shows that the majority of the NFLPA wants the marijuana policy changed.
You lost me with math. I am going to assume your stats are up to snuff lol.
The only other benefit I could see of suing is that it keeps it in the headlines and thereby pressures Goodell and the NFL to compromise just to sweep it under the rug.
Someone more well versed than I may know the answer to this, but I am assuming that the way this statement was phrased was to preserve his lawsuit options. If nothing else, would he have a case that even if the 12-month suspension is appropriate, that the clock should have started 9 months ago when this all began instead of during Week 4 of the preseason? Could he win a case where he argues that the NFL did not fulfill their obligations under the CBA and get reinstated as soon as 3-4 months from now?
