April 13, 2016Where there’s smoke, there’s Josh Gordon. Following up on the initial reports from FOX Sports claiming that the Cleveland Browns wide receiver failed a drug test roughly one month ago, Cleveland.com’s Mary Kay Cabot reports that Gordon’s application for reinstatement into the NFL has officially been denied. According to Cabot, who filed the report on Tuesday afternoon, Gordon is without a timetable for return, but can reapply for reinstatement on August 1, after the start of Browns training camp.
This report corroborates with Adam Schefter’s original addendum to the FOX report, stating that the NFL would now wait 60-90 days before considering Gordon to be added back into the league’s active mix. Cabot adds that the NFL will need to see “a serious commitment” from Gordon, “including a possible stint in an inpatient rehab facility.”
Josh Gordon’s petition for reinstatement from his indefinite drug ban was denied Tuesday by the NFL, a league spokesman told cleveland.com.
The Browns’ receiver, who was suspended Feb. 3 of 2015 and sat out all last season, can reapply later this year, NFL spokesman Brian McCarthy said. He provided no timetable, but a league source said Gordon can try again Aug. 1, which is right after the start of training camp.
It means his availability for the 2016 season is in serious jeopardy, because the league can still decide on his case “when appropriate” after his application. Normally, they try to make such decisions within about 60 days, but it’s up the discretion of Commissioner Roger Goodell.
The amount of marijuana in the samples was less than the 35 nanograms required for a positive test, according to the FOX report. Where Gordon is getting tripped up, however, is that a diluted sample that contains traces of a banned substance is deemed a positive test for a player in Stage 2 or Stage 3 of the NFL’s substance abuse program. Gordon, who has been suspended for 27 of his last 32 games, is in Stage 3. Had the positive test occurred following a potential reinstatement, Gordon would been suspended indefinitely once again, with reapplication in a year. In a bizarre twist of fate, coupled with the league’s rules on the matter, Gordon may be able to see the field at some point this season—as fleeting of a chance this may be.
Additional reports are circulating surround the leaked test. Rather than Drew Rosenhaus, Gordon’s agent, attempting to get his player clean, he is pursuing an investigation into the leaks.
On multiple occasions over the last 24 hours, someone has violated the confidentiality provisions of the substance abuse policy in relation to Browns receiver Josh Gordon.
The first came when someone leaked to FOX Sports, the Associated Press, and NFL Media that Gordon had failed a drug test last month. The second came when someone leaked to Adam Schefter of ESPN that the NFL wants to see Gordon stay clean over the next two or three months before reinstating him.

Arguably, the league itself committed a per se violation of the confidentiality provision via the report of the failed test from the league’s in-house media conglomerate. Since NFL Media is the NFL, anything reported by NFL Media is reported by the NFL. And the NFL, in theory, has the ability to request that its employees identify the sources of the information that resulted in the breach.
The Browns, meanwhile, have yet to offer much in the way of a comment as head coach Hue Jackson and the front office appear solely focused on the upcoming NFL Draft, set to take place in two short weeks. While the team is bereft of talent across the board and are frequently tied to taking a quarterback early, their wide receiving corps remains as one of the largest holes on the roster.

I don’t know why the NFL just doesn’t change policy. Formerly illegal substance is now legal in most places, and these guys are playing football PLUS this substance is known to possibly heal some effects of concussions. It is now prescribed by doctors… SMH

Going after the League for leaking the failed test is exactly the kind of thing an agent should be doing. I’d expect the NFLPA too.
It’s still a misdemeanor carrying one year of prison and $1000 fine maximums everywhere in the United States.

Not medicinal
Under Federal Law, possession of marijuana is still illegal, regardless of whether it is medicinal or not.

hi NJ0 … here in toledo , it has been decriminalized … no fines or jail sentences for possessing up to 200 grams.
this is another thing we don’t talk about … how much it costs to jail non-violent offenders.
Possession of less than 100 grams of marijuana has been decriminalized in Ohio, but it is still punishable by a fine of up to $150 even as a minor misdemeanor. Possession isn’t a felony unless you have more than 200 grams. And any amount between 100 and 200 grams is a misdemeanor, which may result in a fine of up to $250 and a jail sentence up to 30 days.
But possession of any amount of marijuana is still a federal misdemeanor everywhere, including Ohio and regardless of whether its for medicinal or recreational purposes.

State and local laws are not Federal law. Ohio decriminalizing possession does not negate or overrule Federal law. It is still very much against Federal law to possess, use, or grow marijuana. Now, the likelihood of an average Joe being arrested for using is probably negligible, but the fact remains it is illegal. To say marijuana is decriminalized or legal is technically wrong (or at least half the story).

That’s very interesting. I hadn’t heard about that. Honestly, this is how major changes usually occur in our law and government… a slow build of localities and states changing things until a certain tipping point is hit and then the Feds follow suit.
I guess we’re just going to have to disagree as to the meaning of “most places.”

Seemed pretty legal in Amsterdam and Copenhagen when I was there. Also Colorado. And dorm rooms everywhere.
Yeah, it’s a funny thing (and not to pick on anyone here), but it’s a pretty common misconception particularly among people out in my state of CA. Since it’s been allowed here for the past 10 years, people legitimately think it’s legal, even though it’s still federally banned. I’m seriously shocked that the state “legality” vs. fed hasn’t come to a litigated head at this point (either through sales/interstate commerce or other angle such as medicinal). Maybe old Josh can get his name in the law books in the landmark case of Gordon v. Goodell.

Aren’t a bunch of neighboring states suing Colorado on those grounds?
I could be wrong (prob am), but I thought that was dismissed…and the Obama admin is urging a hands off approach w courts and DOJ. Not sure though. Anyway there are a bunch of crappy states around Colorado…no one should care what they think. That’s my legal argument.
Great thing about state v. state: straight to the Supremes! Bypass all of those admin folks.
